How to obtain signer consent for SMS signature requests?
To comply with the Telephone Consumer Protection Act (TCPA), BoldSign requires senders to secure consent from recipients before sending any SMS notifications. It is the sender’s responsibility to gather this consent directly before using BoldSign to send documents via SMS.
BoldSign does not collect this consent on behalf of senders, but it is the sender’s responsibility to ensure it is obtained.
Follow the steps below to obtain signer consent for receiving SMS:

Contact the signer -
Initiate communication with the intended signer through an alternative channel, such as email or a phone call, to inform them about the upcoming SMS signature request. This step establishes initial contact and prepares them for the request. -
Explain the process -
Clearly articulate the purpose of the signature request, the specific document or agreement they are required to sign, and why SMS is being employed for this purpose. Transparency is key to obtaining informed consent. -
Request approval -
Ask for the signer’s consent to receive an SMS signature request. You can use the following template as a starting point:"Hello [Signer’s Name],
I would like to send you a document for your signature via SMS using our BoldSign application. Are you comfortable receiving the signature request on your mobile phone. Please reply with ‘YES’ to provide your consent, or ‘NO’ if you prefer an alternative method.
If you choose ‘YES,’ please know that you can stop receiving SMS messages from BoldSign at any time by texting “STOP.” You will then receive a confirmation message that you have been unsubscribed. After that, you will no longer receive any text messages from us. If you want to rejoin, simply text “START” and we will resume sending you SMS messages.
